Summary:The following contribution shows how social and economic demands of three periods determined the protection of private property according to the Colombian constitution of 1991. Conceptions of property and the constitutional process in this country have to be considered from a different perspective than in Western Europe. It seems unusual that one single constitutional guarantee emphasise the historical significance of land property, the necessity of social reform and access to natural resources and common property. The Colombian doctrine according to art. 58 of the Constitution of 1991 responds as well to the utilitarism of and the social solidarism of as to the responsibility for the environment. The question is, whether it is possible to integrate such different interpretations of property. The conception of „generation rights“ may be the answer.
