| Abstract | Resumen La regulación vigente del Código Penal contempla un tipo de falso testimonio en el art. 206, una figura híbrida de perjurio y falso testimonio en el art. 210 y una figura residual de perjurio en el art. 212. Hasta ahora, la doctrina, en contraste con la jurisprudencia, ha prestado más atención al tipo de falso testimonio que a las normas sobre perjurio, sin siquiera preguntarse por la razón que pudiera justificar la existencia de dos normas sobre el mismo delito. A partir de un análisis de la estructura y contenido de injusto del tipo de falso testimonio, el presente trabajo ofrece una propuesta de delimitación del ámbito de aplicación de tales normas que al mismo tiempo se sustenta en una diferenciación del contenido de injusto descrito por el tipo del art. 210 y por el tipo del art. 212. |
