Summary: | The US Supreme Court, with a new justice joining last term and another for next term, nevertheless seems to be continuing with its generally split decisions. In the Henri Group, HV v. City of New York case, the court held that New York City has no claim under the Racketeer Influenced and Corrupt Organizations Act against out-of-state cigarette retailers that failed to report to New York for tax purposes information on sales of cigarettes to New York City residents. When the Supreme Court returns in October, it will hear oral argument in three state and local lax cases (two of which have been consolidated) and consider requests tor certiorari in two others, all carried over from the prior term. The Court also will welcome its newest member, Associate Justice Elena Kagan, who, following her confirmation by the US Senate, was sworn in on 8/7/10 as the 100th Associate Justice of the Supreme Court |
