Summary:The Traffic Commissioner (TC) has disqualified a transport manager indefinitely after finding that he colluded with another haulier to help his company continue trading after its licence was revoked. TC Kevin Rooney said Phillip Edney had also made a false statement when he applied for an O-license in the name of Harcourt Motors and claimed his new business was for new work. Instead the TC found Edney was working with disqualified operator Daniel Cleaver and his father Francis Cleaver to continue the A W Cleaver Haulage business, which had previously lost its license. An Office of the Traffic Commissioner caseworker noticed large payments to the company's bank account from Daniel Cleaver and W Cleaver, and when questioned about it. Edney said they were loans. He said he had been working for the Cleavers, but realized there was a lot of haulage work available and so he decided to set up a business, with no connection to Cleaver.
