Summary:The 11th U.S. Circuit Court of Appeals ruled that the Immigration and Naturalization Service (INS) was within its legal rights to deny Elian an asylum hearing. The 6-year-old's great-uncle, Lazaro Gonzalez, filed the hearing petition against the wishes of Juan Miguel Gonzalez, Elian's father and sole surviving parent. "We have not the slightest illusion about the INS's choices: the choices about policy and about application of policy," read the ruling of circuit court judges J.L. Edmondson of Atlanta, Joel Dubina of Montgomery, Ala., and Charles Wilson of Tampa, Fla. "Still, the choices were not unreasonable, not capricious and not arbitrary, but were reasoned and reasonable. The INS's considerable discretion was not abused," concluded the judges.
