Summary: | King issued the ruling at the behest of David Dryden, a St. Albans smoker who filed a lawsuit saying that the county's smoking ban is unconstitutional. The prohibition, which took effect earlier this month, bars smoking in restaurants, parking garages, drive- through lines, sports arenas and bingo halls. The smoking ban isn't total. Under the regulations, smoking is allowed in areas of the Tri-State Racetrack & Gaming Center in Nitro, gaming facilities licensed by the state and bars that make 80 percent of their revenue selling alcohol. Kanawha County is one of 46 West Virginia counties with some form of smoking ban. This fall, the state Supreme Court is scheduled to consider Cabell County's smoking ban, which was tossed out last year by a Cabell Circuit judge. |
