The NAACP Legal Defense Fund is watching the case and said the failure to approve Harper's application might be a violation of federal fair housing laws. The county zoning code calls for five-acre lots in the Croom area. However, special exceptions are permitted for existing buildings as long as owners apply for them within 180 days. Harper applied for the "nonconforming use" permit less than two weeks after buying the property. Harper and the opponents disagree over when the 180-day clock started to run. The government is not bound by local zoning restrictions, so the use of the property was legal when the Army owned it. Opponents said Harper was ineligible for an exception because the site has been vacant for three years.
