Graham's Republican opponent, Scott Burns, the Utah Eagle Forum and several GOP legislators say Graham's abortion-rights leanings could damage the law's chances in an upcoming review by the 10th U.S. Circuit Court of Appeals in Denver. The high court ruled a week ago that the 10th Circuit was wrong in striking down the entire 1991 abortion statute simply because much of it was found unconstitutional. The decision, heralded as a victory for the authority of state legislatures, returns the portion of the law that bans abortions after 20 weeks of pregnancy to the 10th Circuit for a rehearing. |
