Summary:"Danny Toal was not a murderer and not a killer . . . He was shocked and outraged by what Tommy Lydon did," Toal's attorney, Martin Efman, told jurors. Toal intended only to steal [Robert Greene]'s stereo, Efman said. Toal does not mention in his written confession that he and Lydon discussed whether Lydon would kill Greene before they burglarized her apartment. In the videotape, however, Toal is asked by police whether Lydon told him before the heist that he'd have to "ice" Greene, and Toal says yes. But Toal also says on the videotape that he didn't believe Lydon. Also in the videotape, Toal tells police that Lydon "always" carried knives. But Efman noted that Toal also confessed that he hadn't seen Lydon for six months and didn't know he was carrying a knife that morning until he saw Lydon running out of Greene's bedroom, his hands bloody and clutching an object that looked like a knife.
