Summary:Henry Morgentaler said Thursday he will sue former Nova Scotia premier John Buchanan after Canada's highest court struck down a provincial law designed to close his Halifax abortion clinic. Speaking from his Toronto clinic, Morgentaler said he would soon file a suit claiming ``malicious prosecution'' against Buchanan and two members of his 1989 cabinet, health minister David Nantes and attorney-general Thomas McInnis. Soon after the law was passed, Morgentaler was charged with performing 14 abortions at his newly opened Halifax clinic. He reopened the clinic after a provincial court judge ruled the law, which called for fines of up to $50,000, exceeded provincial jurisdiction by prohibiting and regulating abortions, which is a federal power.
