According to Kenya's Ministry of Labour, an employee is entitled to that gratuity so long as he or she does not receive a pension, is not party to an existing collective bargaining agreement that provides for an alternative or waives it, and is not a member of Kenya's National Social Security Fund-none of which apply to the onboard service workers.
