Summary:First and foremost, ABI has second-to-none restructuring and insolvency education (note that I did not say bankruptcy education). There will always be distressed borrowers that need to avail themselves of these Bankruptcy Code provisions, and rightfully so. Sometimes it might be more cost-effective, or jurisdictionally specific, to conduct an assignment for the benefit of creditors in order to maximize value and distribute to creditors. Or an Article 9 foreclosure sale when a secured lender exercises its remedies when other, more expensive options might not be available.
