Summary:This chapter focuses on Weinstein's involvements since Agent Orange. His ventures with asbestos litigation and later mass tort cases proved much less successful than Agent Orange. However, he continued to innovate and made significant contributions, including reconstruction of the Manville Personal Injury Settlement Trust, which came to be a paradigm for compensating asbestos victims; stimulating the first use of a panel of experts in the breast implant litigation; writing an opinion in the DES litigation, which was a small treatise on determining damages; writing major opinions to modify traditional limits on personal jurisdiction where mass torts were involved; and engaging in a fascinating (and, finally, losing) battle with Congress over the use of federal agency data in litigation involving the importing of guns into New York City.
