严复法哲学思想研究 : 以《法意》翻译案语为例

19世纪末20实际初，中国受到传统和现代的双重冲击。严复以英译版为原本，翻译了孟德斯鸠《法意》一书并在书中有针对性的插入案语进行引伸评议。案语集中体现了严复的儒家法哲学思想。严复一破一立古今中外进行对比，一方面揭露了君主专制的弊病、传统司法弊端和刑讯酷烈，论证了变革传统法律对国富民强的迫切性；另一方面从比较法律文化的广阔视野发掘中华文明得以接续近代文明的优良传统资源，绘制了中国法制变革的理想蓝图和自我革新的道路，推动了清末法制由传统向近代的转型。 In the late 19th century and early 20th century, China was affected by both tradition and modernity. Based on the English version, Yan Fu translated Montesquieu's The Spirit of the Laws and made some comments. The text embodies Yan Fu's Confucian legal philosophy. On one hand, Yan Fu exposed the malady of monarchy, the malpractice of traditional judicature and the severe punishment of torture. He drained the beneficial foreign cultural nutrients such as freedom, civil rights, the rule of law, etc. According to Chinese national conditions, he demonstrated the urgency of reforming the traditional law for the nation becoming wealthy and the people being powerful.
