국가지질공원 내 지질명소의 법적 보호체계를 위한 제언

국내에 존재하고 있는 다양한 지질유산 중에서 그 뛰어난 지질학적 가치가 입증된 지질유산들은 문화재보호법에 의해 보호를 받고 있다. 하지만 지질유산적 가치가 있음에도 불구하고 일부 지역들은 적절한 법적인 보호를 받고 있지 않아 훼손 가능성이 존재한다. 유네스코에서는 세계지질공원으로 인증하는 지역의 모든 지질명소에 대해 법적인 보호조치를 요구하고 있으나, 국내에서 국가지질공원으로 신청하고 인증된 지역 내에는 법적인보호조치를 받지 못하고 있는 지역들이 있다. 또한, 법률 대신에 구속력이 적은 조례에 의해 보호를 받고 있는것이 현실이다. 따라서 유네스코 세계지질공원의 지침을 준수해야 하는 국가지질공원에서는 지정된 모든 지질명소에 대한 보호방안을 가까운 장래에 수립하는 것이 시급히 요구된다. 국내에는 문화재청, 환경부, 해양수산부 등 여러 부처 소관 하에 국내 지질유산을 보호할 수 있는 법률이 제정되어 있다. 이와 같이 현재 활용될 수 있는 다양한 법률을 지질유산 보호에 적극적으로 적용하는 것이 필요하다. 따라서 환경부와 국가지질공원을 운영하는 지자체에서는 국가지질공원 내 지질명소를 효율적으로 법적인 보호를 할 수 있는 방안을 개발하는 것이필요하며, 법적 보호를 받지 않고 있는 지질명소를 목적에 맞는 국내 법률을 통하여 보호해야 할 것이다. Numerous significant geoheritage sites in Korea are protected by the Cultural Heritage Protection Act. However, some geoheritage sites are not properly protected under legal protection measures and thus are exposed to destruction due to development and vandalism. Even though the guideline of UNESCO Global Geoparks recommends legal protection for all the geosites in Global Geoparks, the geosites in National Geoparks of Korea still include some geosites without protection measures. Some geosites are protected only by local government ordinances, which cannot be regarded as adequate legal protection. Therefore, it is necessary to establish proper legal protection system for all the geosites in national geoparks in the near future. There are several applicable laws to protect geoheritage sites by the Cultural Heritage Administration, the Ministry of Environment, the Ministry of Oceans and Fisheries etc.. It is thus necessary to apply those acts for protection of significant geoheritage sites as well as geosites in national geoparks, which is the aim of this paper. KCI Citation Count: 6
