디지털성범죄 피해자 지원 프로세스에대한 연구

과학기술의 발달과 인터넷의 보편화, 스마트폰의 대중화로 이제 사이버공간은 일상 생활에서함께 공존하는 개념적 장소로 자리매김하게 되었다. 진보된 기술을 기반으로 정보의 유통은매우 빨라졌고, 지식은 높아졌으나 그로 인해 사이버공간과 결합한 새로운 형태의 범죄가 발생하면서 사회적 문제로 대두되었다. 특히 최근 문제가 되고 있는 디지털성범죄에 대해 국민 불안감을 해소하기 위해 정부에서는2017년 9월 『디지털성범죄 피해방지 종합대책』을 마련한 바 있으며 관련 법안이 논의되고있으나 법과 제도가 빠르게 변화하는 현실을 따라가지 못하는 한계로 인해 공백 상태가 발견되고 있어 피해자가 겪어야 할 고통을 가중하고 있다. 디지털성범죄는 단지 발생장소만 사이버공간으로 이동했을 뿐 그 보호법익에 대한 피해의정도는 기존 성범죄 피해와 다르지 않으며 오히려 사이버공간을 이용한 빠른 전파성으로 인해불법촬영물이 유포되면 영구삭제가 거의 불가능하여 사회적 문제가 더욱 심각하나 현재의 디지털성범죄 피해자 지원제도로는 부족한 실정이다. 본 논문에서는 다양한 디지털성범죄에 대한 선행연구의 검토를 통해 관련 법률과 제도를 조사･분석하고 디지털성범죄 발생현황과 전반적인 법률적･기술적･제도적 문제점을 살펴봄으로써 그 공백을 개선할 수 있는 방향을 제시하여 개선된 디지털성범죄 피해자 지원 프로세스를도출하고자 하였다. With the development of science and technology, the universalization of the Internet, and the popularization of smartphones, cyber space has become a conceptual place that coexists together in everyday life. Based on advanced technology, the circulation of information has become very fast and knowledge has increased, but it has become a social problem as a new type of crime combined with cyber space has occurred. Especially, in order to solve the public anxiety about the digital sex offense which is a recent problem, the government prepared ‘the comprehensive measures to prevent the digital sex crime’ in 2017 September and the related legislation is being discussed. However, due to the limitations that laws and institutions can not keep pace with the rapidly changing reality, there are blank states about legal punishment and the victim is increasingly suffering. The victim's digital crime was only moved to cyberspace, The digital sex crime is not only different from the damage of the real sex crime. And due to the rapid propagation using cyber space, if illegal vedios are distributed, permanent deletion is almost impossible. So The social problem is more serious, but it is not enough to support the current victims of digital sexual crimes. Therefore, this paper investigates and analyzes related laws and systems through examining previous studies on various digital sexual offenses, and suggests ways to improve the gap by examining the current status of digital sexual crimes by looking at overall legal, technical and institutional problems And to elaborate an improved process for supporting victims of digital sexual crime.
