환경권의 의미 확장을 위한 시론적 고찰: 서산 대산공단 인근 주민 사례를 중심으로

최근 심각한 전지구적 기후붕괴 국면에서 환경권에 대한 관심이 높아지고 있다. 본 연구는 환경권에 대한 다양한 논의 중에서도 자연과 인간의 관계에 대한 전환적 태도를 강조하는 담론에 주목하면서 ‘인권으로서의 환경권’의 형태를 제시한다. 그동안 세대별 인권 개념 속에서 환경권은 공간적, 내용적 범위 규정의 모호함으로 인해 ‘인정이 요구되는 권리’로 이해되어왔다. 그러나 집단의 권리와 연대를 강조하는 환경권은 오늘날의 환경오염, 경제적・사회적 불평등을 해소하는 데 매우 유용하게 쓰일 수 있다. 1948년 세계인권선언 이후 선포된 환경 관련 ‘인권정전’을 범주화하고 사례를 통해 분석한 결과, 실제 환경권은 보편성, 불가분성, 상호의존성이라는 인권의 본질을 명확하게 보여주는 개념이라는 것이 드러났다. 가령 수십년간 석유화학공단에서 발생하는 환경오염으로 고통받고 있는 충남 서산 대산공단 인근 마을 주민의 경우, 지구와 생명공동체의 보호를 고려한 자원이용, 환경보호와 평등을 고려한 지속가능한 개발, 환경과 인권에 대해 교육 받고 정보에 접근할 권리, 환경재난에 대한 법적 구제 및 보상받을 권리, 건강한 생태환경에서 발전할 권리, 환경오염에 대한 의사결정에 참여하고 저항할 권리를 지속적이고 다양한 형태로 침해받고 있었다. 이들은 때로 권리 개선의 새로운 국면을 맞이하기도 했는데, 이 상황 에서 환경문제에 대한 인권적 접근이 강하게 요구되었다. 주목할 점은, 권리보유자가 자신의 상황을 설명하고 피해를 설정하여 책임을 묻는 데 환경권이 매우 유용하게 쓰일 수 있다는 것이다. 본 연구에서는 ‘인권으로서의 환경권’ 개념을 구체화하여 환경문제의 근본적해결을 위한 유용한 도구를 제시한다. Recently, Interest in environmental rights has increased in the face of serious global climate change. This study presents the concept of ‘Environmental rights as human rights’ by focusing on discourse that emphasizes a transformative attitude toward the relationship between nature and humans. Third-generation human rights have been understood as a new category of human rights. However, environmental rights, as third-generation human rights, emphasize collective concepts such as community or people. Thus, solidarity can be very useful in addressing contemporary environmental pollution and economic and social inequality. By analyzing the Human Rights Canon since the 1948 Universal Declaration of Human Rights, it becomes clear that the concept of environmental rights demonstrates the essence of universality, indivisibility, and interdependence of human rights. For example, residents of villages near the Daesan Petrochemical Complex in Seosan, Chungcheongnam-do, who have suffered from environmental pollution caused by petrochemical plants for decades. They have been violated various rights such as ‘rights related to resource use considering the protection of the earth and the community of life, rights related to sustainable development considering environmental protection and equality, rights related to receiving education and access to information on the environment and human rights, rights related to legal remedies and compensation for environmental disasters, rights related to developing in a healthy ecological environment, and rights related to participating in decision-making and resisting environmental pollution, rights related to sustainable development considering environmental protection and equality, rights related to receiving education and access to information on the environment and human rights, rights related to legal remedies and compensation for environmental disasters, rights related to developing in a healthy ecological environment, and rights related to participating in decision-making and resisting environmental pollution’. Sometimes, they have faced new phases of rights improvement. In this situation, a human rights-based approach to environmental issues was demanded strongly. The concept of environmental rights was very useful in explaining their situation and asking for responsibility. The environmental rights as human rights presented in this study can help promote fundamental solutions to environmental problems from a human rights perspective. KCI Citation Count: 0
