Summary:The change in economic, social and environmental behavior that was brought about by scientific and technological advances from industrial development ended up establishing a true environmental crisis. The referred crisis revealed to be a global environmental problem. In the face of such global environmental problems, new challenges to democracy arise, therefore, in this context, the Democratic State of Environmental Law comes to light as a way out. This work used the deductive method, and based on bibliographic research, it sought to demonstrate the importance of substantially incorporating the principles of Environmental Law into decision-making processes, whether public or private. In this way, the aim is to provide an ethical-environmental performance in the formulation of public policies, in the creation of standards, and also in the consideration of the environmental variable in the most varied public or private decision-making processes. In conclusion, it appears that environmental principles have not been satisfactorily incorporated into both public and private Brazilian decision-making processes, increasingly separating the Brazilian State from the Democratic State of Environmental Law model.
