Summary: | The authors state methodical approaches to the definition of real damage and also the missed benefit subject to compensation to users and proprietors of farmlands at their withdrawal. Methods of concrete calculations in various directions of use of alienable lands of the agricultural purpose are offered. The authors define the damage of agricultural commodity producers connected with loss of soil fertility in the process of the alienation and necessity of its subsequent restoration. The order of distribution of the missed benefit in profit of the land owner (state) and the land user (agricultural organizations) is installed. Rates of productivity of the grain and leguminous cultures formed at the expense of natural and artificial fertility are put in the basis of such distribution of the missed benefit. Calculation value of the missed benefit in the first case belongs to the state, in the second - to the agricultural organization. Offered mechanisms and directions of definition of the real damage and the missed benefit can be used as the methodical base of the calculation of compensatory payments at withdrawal (including temporary allotment) of farmlands for building gas and oil pipelines, electric mains and other kinds of using as for needs of subjects of management of residents of the Republic of Belarus and non - residents |
