Summary:The present invention relates to a motion recognition-based hands-on determination apparatus, a system including the same, and a vehicle control method thereof. The motion recognition-based hands-on determination apparatus according to one embodiment of the present invention comprises: a processor which determines a driver's hands-on state through motion recognition, and determines whether to use a motion recognition-based hands-on determination result based on at least one of a weather condition, a motion sensing validity condition, a driving road classification, a vehicle control condition, and a driver condition; and a storage unit for storing data for the motion recognition. According to the present invention, time delay from a hands-off state to the hands-on state of a steering wheel can be minimized. 본 발명은 모션 인식 기반 핸즈 온 판단 장치, 그를 포함한 시스템 및 그 차량 제어 방법에 관한 것으로, 본 발명의 일 실시예에 따른 모션 인식을 통해 운전자의 핸즈 온(hands on) 상태를 판단하 판단하고, 기상 조건, 모션 센싱 유효성 조건, 주행 도로 구분, 차량 제어 상태, 및 운전자 상태 중 적어도 하나 이상을 기반으로 상기 모션 인식 기반 핸즈 온 판단 결과의 이용 여부를 판단하는 프로세서; 및 상기 모션 인식을 위한 데이터가 저장되는 저장부;를 포함할 수 있다.
