Abstract Provided are a non-aqueous electrolyte battery, which prevents side reaction caused by the formation of a protection film on the surface of a positive electrode comprising manganese phosphate lithium, and a battery pack and a vehicle comprising the same. The non-aqueous electrolyte battery of the present invention comprises a positive electrode, a negative electrode, and non-aqueous electrolyte. The positive electrode comprises a positive electrode active material comprising a compound represented by a composition formula, LiMn_(1-x-y)Fe_xA_yPO_4, wherein A is at least one element selected from the group consisting of Mg, Ca, Al, Ti, Zn and Zr and satisfies 0 <= x <= 0.3, and 0 <= y <= 0.1. The positive electrode has a ratio (I_(P-F)/I_(P-O)) of a peak intensity (I_(P-O)) of a P-O bond to a peak intensity (I_(P-F)) of a P-F bond, which are measured by X-ray photoelectron spectroscopic analysis on the surface of the positive electrode, to be 0.4 or more and 0.8 or less.
