The present invention relates to a semiconductor device and a manufacturing method thereof. Provided is the semiconductor device which includes an active pattern which protrudes from a substrate, a gate electrode which crosses the active pattern, a gate spacer on the sidewalls of the gate electrode, source/drain regions which are arranged on the active patterns of both sides of the gate electrode, wherein each of the source/drain regions includes a part which is exposed by the gate spacer and a second part which is extended from the first part and is covered by the gate spacer, and a remaining space which is interposed between the gate spacer and both sidewalls of the second part to face each other. Accordingly, the present invention can improve electrical properties of the semiconductor device. 본 발명은 반도체 소자 및 그의 제조 방법에 관한 것으로, 기판으로부터 돌출된 활성 패턴, 상기 활성 패턴을 가로지르는 게이트 전극, 상기 게이트 전극의 측벽들 상의 게이트 스페이서, 상기 게이트 전극의 양 측의 상기 활성 패턴 상에 배치되는 소스/드레인 영역들, 상기 소스/드레인 영역들의 각각은, 상기 게이트 스페이서에 의해 노출되는 제1 부분, 및 상기 제1 부분으로부터 연장되고, 상기 게이트 스페이서에 의해 덮히는 제2 부분을 포함하고 및 상기 제2 부분의 마주하는 양 측벽들과 상기 게이트 스페이서 사이에 개재되는 잔류 스페이서를 포함하는 반도체 소자가 제공된다.
