Summary:PURPOSE: A broadcasting signal transmitting/receiving apparatus and method thereof are provided to obtain receiving performance of a layer service in a section which an enhancement layer service does not exist. CONSTITUTION: A base layer(810) signal is generated by including a base layer symbol and a sub channel. An enhancement layer signal including an enhancement layer symbol is generated. The enhancement layer symbol is generated by a layer modulation index in a first sub channel. The base layer symbol is outputted in a second sub channel.
