시체 기증에 대한 예우 및 지원 제도 개선방안 연구

2020년 4월 7일에 개정된 시체해부법 및 같은 법 시행규칙에 따라 국가 차원에서 시체 기증자 본인 및 유족에 대한 예우 및 지원 활동과 기증된 시체를 연구 목적으로 제공할 수 있게 되었다. 따라서 개정된 시체해부법의 취지에 적합하도록 기증 및 활용이 활성화되기 위해서 제도 내합리적으로 일관되게 적용가능한 기증자 예우 및 지원에 대한 방안이 확립되고 이를 각 기관에서활용하여 추진하는 것이 필요하다. 그러나 현행 시체 기증 제도는 시체해부법에서 정한 바를 충분히 적용할 만큼 국가 및 지방자치단체 차원에서 지원체계가 확립되어 있지 않다. 목적별 기증시체를 활용하기 위해서는 통합된 관리가 필요하나, 기관 중심으로 기증된 시체를 관리하고 있어효율성이 떨어진다. 더욱이 유교 문화를 기반으로 하는 우리 사회에서 시체 기증에 대한 부정적인식은 극복해야 할 문제이다. 본 연구에서는 현행 시체 기증 제도의 한계를 극복하기 위한 개선방안으로 1) 법률 개정을 통한 제도 개선 방안, 2) 국가 차원의 통합관리체계 구축 및 운영, 3) 기증자 예우 및 지원 사업 계획 및 추진을 제안하고자 한다. The Korean Anatomical Anatomy Act, amended on April 7, 2020, and its imple- menting regulations, have made it possible to provide honor and support activities to cadaver donors and their survivors at the national level and donated cadavers for research purposes. To implement cadaver donation and utilization per the revised Anatomical Anatomy Act, it is necessary to establish a reasonably consistent and applicable donor honor and support plan within the system and then utilize and promote it at each institution. However, the current cadaver donation system does not include an estab- lished support system at the national and local levels to fully apply the provisions of the Anatomical Anatomy Act. Despite the need for an integrated management system to utilize donated cadavers, the current management of donated cadavers is centered on individual institutions, resulting in low overall efficiency. Furthermore, the negative perception of body donation in Korean society, which is based on Confucian culture, is a challenge that must be overcome by improving awareness. This article proposes the following improvements to overcome the limitations of the current body donation system: 1) revising the law to improve the system, 2) establishing and operating an integrated nationwide management system, and 3) planning and promoting donor honor and related support projects.
