상앙(商?)의 법(法)과 힘

과연 폭력이 때로는 불가피한가? 만일 그렇다면, 법은 불가피한 폭력의 일종으로서 이해될 수 있는가? 본고는 이와 같은 현대 법철학적 근본 문제들이 고대 법가(法家) 상앙(商鞅)의 사상에서 어떻게 중첩되어 드러나는지를 살펴본다. 상앙의 법치는 근본적으로 힘(力)에 기초한다. 그리고 상앙은 힘의 통치만이 정치사회적 질서(治)를 가져온다고 주장한다. 이에 상앙은 두 가지 정당화 논리를 제공한다. 이 둘을 살펴보는 것이 본고의 주제이다. 첫째, 상앙은 역사적 상상력을 통해 법의 기원을 추정함으로써 역사 발전 과정상 법치 도입이 필연적이었음을 주장한다. 즉 그는 역사적 상상력에 호소하여 법치 도입의 불가피성을 정당화한다. 둘째, 상앙은 법치의 정당성을 궁극적으로 공멸의 방지에서 찾는다. 그의 정당화 논리를 종합하여 말하자면, 법치는 인류 전체의 멸망을 피하기 위해 역사 발전 과정상 최종적으로 선택된 공동체적 대응이라는 것이다. 이와 같은 상앙의 입장은 가공(可恐)할 함의를 지닐 수 있다. 왜냐하면, 정치사회적 혼란을 막고 질서를 구현하기 위해 다수에 대한 폭력이 정당화될 수 있다는 논리가 숨겨져 있기 때문이다. 본고는 이 함의를 특히 유가(儒家)인 순자(荀子)의 사상과 비교함으로써 드러내 보이겠다. Can violence be sometimes inevitable? If so, can such inevitable violence be justified as law? This paper examines how these fundamental issues in legal philosophy were nested in the context of the early Chinese legalist(法家) thought. The early legalist Shang Yang(商鞅) argues that governance by law(法) fundamentally relies on enforcement(力), and that the politics of violence is necessary in order to establish sociopolitical orderliness(治). In fact, Sang Yang provides two justifications for the inevitability of governance based on enforcement and by law. This paper examines these two justifications. First, Shang Yang argues by appealing to historical imagination that the adoption of the rule of law became inevitable in the development of human history. In other words, he advocates the necessity of governance by law by speculating about the origin of the rule of law. Second, he seeks to justify governance by law ultimately by arguing that it is the best way to prevent the destruction of the entire human race(亂). In relation to Shang Yang’s view, it is important to notice that his justifications may have some horrifying implication: For instance, in line with his view, violence against the vast majority of people may be rationalized in order to prevent sociopolitical disorder and establish order. This paper aims to explain the formidable danger underlying this implication in Shang Yang’s thought. To do this right, Shang Yang’s view of law is juxtaposed with the thought of early Confucian thinkers, such as Xunzi(荀子). KCI Citation Count: 0
