의회-지배인(Council-Manager) 모델은 한국 지방정치에 적실한 정부형태인가?: 지방자치단체의 기관구성 형태 다양화에 관한 비판적 검토

최근 지방자치법 전부개정에 따라서 지자체의 기관구성 형태가 다양해질 수 있게 되었다. 본 연구의 목적은 지자체 기관구성 형태의 대안으로 자주 거론되는 의회-지배인(CM) 모델이 한국 지방정치 현실에 적실한 모델일 수 있는지 비판적으로 검토하려는 것이다. 국내 선행 연구들은 지방정치에서 되도록 정당의 영향력을 배제하고 행정·입법의 효율성 개선을 위해 CM 모델을 대안으로 제시한다. 하지만 본 연구는 일당이 독점하는 이원적 구조에서 효율성이 저하된다는 기존 주장에 모순이 존재함을 지적한다. 또한, 본 연구는 미국과 한국 간 지방정치 환경이 서로 다르다는 점을 강조한다. 20세기 초 미국 도시들에서는 정당 머신정치의 폐해를 막기 위해 CM 모델이 고안되었지만, 한국은 역사적으로 정당이 아닌 관료의 주도로 자치분권이 이루어져 왔고 한국 지방정치에서 정당-시민 간 정치적 연계는 매우 약하기 때문이다. 게다가 미국에서는 CM 모델의 효과에 관하여 상반된 이론과 엇갈린 경험적 결과가 병존하고 있다. 따라서 이 모델을 한국에 도입하고자 할 때는 제도의 한국적 적실성을 신중히 고려하면서 민주적 차원에서 정당(특히 지역 정당)의 역할을 재고할 필요가 있다. With the recent revision of the Local Autonomy Act, local governments in South Korea now have a legal basis for changing the form of government structure in various ways. This study aims to examine whether Council- Manager model (CM), which is often discussed as an alternative can be a suitable model for Korean local politics. Previous studies based on antipolitical ideas tend to exclude party politics in local area and suggest the CM to improve the efficiency of legislation and administrative process. However, this study points out that there is a contradiction in the argument that it is less efficient in the current local government structure monopolized by a hegemonic party. This article argues that Korean local party politics is different with the U.S. in the 20th century, which introduced the CM to eliminate the evils of machine politics. And since there are conflicting theories and mixed empirical results in the evaluation of the CM, these points should be carefully considered when local government transforming. Also, the discourse on reforming local government form needs to be reconsidered from a democratic side rather than an efficiency and the role of a political party should not be ruled out to establish the principle of resident sovereignty.
