장애인권리협약으로 본 장애인 탈시설 권리의 의미

이 연구는 2006년에 유엔에서 채택된 ‘장애인의 권리에 관한 협약’(장애인권리협약)을 중심으로 장애인 탈시설 관련 국제 규범의 형성 및 변화 과정을 확인하고 장애인권리위원회의 모니터링 대상이 된 해외 국가의 실천 현황을 검토해 장애인 탈시설권리의 의미를 확인해 보고자 한다. 먼저 장애인권리협약이 채택된 맥락 및 협약의주요 내용을 검토하여 장애인 탈시설의 의미를 확인하였다. 이어서 일반논평이나 가이드라인 등 부속 문서를 검토해 장애인 탈시설의 의미가 구체적으로 해석되는 과정을 확인하고, 협약 이행 상황 모니터링 결과를 검토하였다. 마지막으로 장애인권리협약 비준 이래 한국에서의 탈시설 관련 논의 현황을 검토하였다. 검토 결과 장애인 탈시설 권리는 장애인권리협약에서 핵심으로 강조하는 권리라는 점을 확인하였다. 동시에 권리 실천의 과정은 단선적이지도 불가역적이지도 않은 현재진행형이라는 점을 확인하였다. 이러한 검토 결과를 토대로 탈시설 권리 보장을 위해 필요한 과제를 입법적, 행정적, 사법적 차원에서 제시하였다. This study focuses on the Convention on the Rights of Persons with Disabilities (CRPD), adopted by the United Nations in 2006, to identify the process of formation and change of international norms related to deinstitutionalization of persons with disabilities and to find implications for Korean society by examining the practices of overseas countries monitored by the Committee on the Rights of Persons with Disabilities. Specifically, we examined the context in which the Convention on the Rights of Persons with Disabilities was adopted and the main contents of the Convention to determine the meaning of deinstitutionalization. We then examined the subsidiary documents, such as the General Comments and the Guidelines, to see how the meaning of deinstitutionalization has been materialized and interpreted, and reviewed the results of monitoring the implementation of the Convention. Finally, we reviewed the status of discussions on deinstitutionalization in Korea since the ratification of the Convention on the Rights of Persons with Disabilities. The results of the review confirm that the right to deinstitutionalization is a core right emphasized by the Convention. At the same time, we found that the process of realizing the right is an ongoing process that is neither linear nor irreversible. Based on the findings of this review, we suggests challenges that need to be addressed at the legislative, administrative and judicial levels to ensure the right to deinstitutionalization.
