특허권의 이전청구에 따른 미등록 실시권자의 보호 방안

우리 특허법은 무권리자의 특허출원임을 이유로 무효 사유가 있는 특허권에 대하여 정당한 권리자의 이전청구가 가능하도록 제도를 도입하였다. 그리고 형식상 특허권을 가지고 있던 무권리자로부터 실시권을 설정받아 등록한 자는 선의로 실시사업을 하거나 준비를 하고 있는 범위 내에서 유상의 통상실시권을 가지게 된다. 그런데 대부분의 통상실시권은 등록되지 않은 상태에 머무르고 있으며 이러한 실시권자의 법적 지위는 특허권자의 변동에 따라 불안정한 상태에 놓이게 된다. 이에 실시권자가 실시권의 등록 여부와 관계없이 새로운 특허권자에게 대항할 수 있도록 하고 특허권의 이전청구 기한을 제한하며 그 이전청구 사실을 실시권자에게 통지하거나 공시하여 미등록 실시권자의 실시 상태를 보호할 수 있는 방안이 요청된다. The Korean Patent Act provides a legal mechanism for rightful owners to claim the transfer of patent rights filed by individuals lacking legitimate entitlement. It also grants a paid, nonexclusive license to those who, in good faith, obtain and register a license from such unauthorized patentees, covering the scope of the invention being practiced or prepared for practice. However, in practice, most non-exclusive licenses remain unregistered, resulting in an unstable legal status for licensees, particularly when patent ownership changes. Therefore, there is a growing need for legislative measures to ensure that licensees assert their rights against new patent holders, regardless of their registration status. Key recommendations introducing a statutory limit on the period within which assignment claims can be exercised, and mandating that such claims be formally disclosed to licensees. These protections would ensure that unregistered licensees can continue exercising their rights and reduce legal instability in patent transactions.
