감옥소설에 나타난 폭력적 광기의 양상 연구 「태형」, 「인간동물원초」, 「선생과 황태자」, 『오래된 정원』을 중심으로

본고는 「태형」, 「인간동물원초」, 「선생과 황태자」, 『오래된 정원』 등의 네 편의 감옥 소재 소설을 통해 감옥이라는 특수 공간을 중심으로 펼쳐지는 폭력적 광기의 네 가지 양상을 살펴보았다. 국가에 의해 독점된 물리력의 행사를 통해 감옥은 수인의 자유를 박탈한다. 명백한 논리적 정당성과 법률적 정확성을 통해 감옥은 수인의 신체를 감금하고 사회로부터 일정시간 격리를 통해 수인을 교화하는 것을 목표로 한다. 하지만 감금하고 교정하고 순종하는 신체로 수인을 구성함으로써 사회적 존재로 재생산하려고 하는 한, 감옥은 엄격한 병영이나 훈육적인 학교, 암담한 노동공간과 별반 차이가 없다. 아니 오히려 더욱 혹독하게 육체와 정신을 제도화하기 위해 감시와 강제 속에 사회적 재생산을 위한 훈육과 담금질의 공간으로 작동한다. 위법행위를 처벌하고 범죄자를 교화하는 공간으로서의 ``감옥``은 폭력적인 공권력 행사의 최후의 보루에 해당한다. 하지만 그 공간은 제도 권력이 기대하는 훈육과 교정의 공간이라기보다는 또 다른 폭력이 잉태되는 공간으로 작동할 수도 있다.「태형」에서처럼 만인을 위한 일인의 희생이 강제되는 공간이며, 「인간동물원초」에 서처럼 동물적 인간들이 약자를 성적으로 독점하여 지배권을 강화하려는 광기적공간이고, 「선생과 황태자」에서처럼 1인 절대권력과 상명하복의 서열의식이 팽배한 우울증의 집합 공간이며, 『오래된 정원』에서처럼 저항 주체에게 무력감과 신경증적 병리 현상을 강제하는 정신병적 공간이 되기도 한다. 근대적 합리성의 이름으로 공권력이 발명해낸 제도로서의 ``감옥``은 범죄자의 사회적 격리라는 순기능도 수행하지만, 감금된 공간에서 벌어지는 또 다른 폭력적양태는 그것이 야기하는 역기능적 후과를 간과해서는 안 되는 인권의 문제임을 보여준다. 감옥에서 벌어지는 폭력의 내성화는 결국 이성의 간계가 제공한 우리 사회의 그늘에 해당하는 것이다. The jail deprive of prisoner`s freedom through exertion of force monopolized by nation. The jail imprisons prisoner`s body through logical justification and legal accuracy, aims prison`s reformation through isolation within a given period from society. However, The jail doesn`t differ from rigid barracks, disciplined school or gloomy labor`s room as long as the prisoner revives a social being by consisting with confinement, correction, obedient. It works discipline for social revive, training room in surveillance and compulsion in order to institutionalize mind and body more than harshly. The jail that punishes illegality and reforms a criminal is the last bastion of abusive exerting governmental power. however, the jail not room of discipline and correction expecting governmental power but room another conceived violence. Like , it forces to sacrifice a man for everybody, like <human being original>, it reinforces control at weak person by sexual exclusion, like <teather and crown prince>, one man wield absolute authority and rank overflowing collective of depression in insane room, like 『The old garden』, it is psychotical room compeling neurotic pathological phenomenon and a feeling of helplessness to resistant subject. By Rene Girard, the violence is good violence and bad violence. And modern judicial system is the most effective system in curable effect among used method so that a man evades chain revenge. But ``the prison`` that system invented by governmental authority carries out the right function social isolation a prisoner ; ``the prison`` doesn`t overlook adverse effect confined room at aspect of another violence. After all, tolerance of violence at jail is shade of society offering trick of reason.
