Summary:In the scientific work, the author noted the relevance of scientific research on intellectual property relations as a prerequisite for their legal regulation, on the one hand, and an indicator of the quality of legal regulation, on the other. It was noted that social relations are a single and universal mechanism, as well as a sphere for revealing and realizing the socially useful potential of any phenomenon or process. Therefore, intellectual property relations are an important factor in establishing and realizing the social usefulness of intellectual property, in further stimulating subjects to creative activity in order to generate new objects of intellectual property, protect or defend the rights of subjects of intellectual property relations. The study of intellectual property relations was conducted through the prism of intellectual property as a value, which became an important aspect of the application of the axiological and legal approach, which allowed revealing intellectual property from the point of view of the real implementation of its usefulness in the life of society, reflecting the real state of demand for intellectual property by society and its legal support. Based on the analysis of doctrinal approaches to the characterization of intellectual property relations, it was concluded that intellectual property relations play an important role in the field of intellectual property, essentially ensuring its reality and usefulness. Taking as a basis the characterization of social relations provided by us from the point of view of the axiological and legal approach to their perception and study, the characterization of intellectual property relations was detailed, which includes the general features of social relations, as well as a system of their own, individualized features: 1) originate from the natural abilities of the human organism to intellectual creative activity; ensuring the emergence, change and cancellation of relations (economic, social, personal, creative, legal, etc.) between subjects of society regarding the process and result of such activity; 2) are aimed at protecting and defending both the process of intellectual, creative activity and the results of creative activity; 3) provide authors with confidence that their work will not be stolen or appropriated, and stimulate further intellectual, creative activity, enhance its innovativeness and creativity; 4) act as an indicator of the stability and inviolability of the rights and interests of subjects, since the violation of intellectual property relations is directly related to the violation or threat of violation of the rights and interests of the subjects of such relations, etc.
