Forms аnd Types of Permit Procedures in the Sphere of Urban Planning

The article is devoted to the study of the issue of forms and types of permitting procedures in the field of urban planning in Ukraine, the definition of legislative regulation of their application. Urban planning is defined as the theory and practice of planning and building cities, which focuses on the connection of this process with the development of productive forces and production relations; and as a complex of economic, organizational, engineering and technical, environmental, legal and other measures aimed at creating and maintaining a viable environment for a person that satisfies his material, social, cultural and spiritual needs, so the above definition emphasizes the integrative nature of urban planning, which combines not only technical and economic aspects, but also social and environmental components. The form of activity is defined as the externally expressed actions of public administration bodies or their officials, carried out within the limits of competence to achieve the set goals and objectives. It is noted that important features of the form of permitting activity in the field of urban development are the need to be accepted exclusively in writing (in paper or electronic form with appropriate details); and the need to be determined by legislation and accepted by authorized entities. The classification of forms of activity of public administration bodies into legal (for example, issuing administrative acts, concluding contracts, carrying out other legally significant actions) and organizational (carrying out social-organizational and organizational-technical measures) is given. It is concluded that the process of making a management decision on issuing permits does not exclude the possibility of making decisions without special registration in cases where a specific form of recording is not provided for such decisions. The article proposes a thesis that economic entities engaged in construction must adhere to clear rules and procedures when resolving documentary issues, therefore, depending on this, two options for issuing permits are proposed: according to a simplified and general procedure. The scientific article describes the types and characteristics of permitting procedures in the field of urban planning. The article provides proposals for regulatory regulation of the implementation of permitting procedures in the field of urban planning.
