O APERFEIÇOAMENTO DO ATIVISMO JUDICIAL X DIVISÃO DOS PODERES NO BRASIL

O estudo investiga o ativismo judicial e a divisão dos poderes no Brasil, com foco nas intervenções do Supremo Tribunal Federal (STF) e suas implicações para o sistema político e jurídico do país. Considerando o contexto de um Judiciário cada vez mais ativo, o trabalho busca compreender as dinâmicas de poder entre os poderes Executivo, Legislativo e Judiciário, bem como os desafios enfrentados na manutenção do equilíbrio institucional. O objetivo do estudo é analisar o impacto do ativismo judicial do STF sobre a divisão dos poderes no Brasil, investigando suas implicações para a democracia, o Estado de Direito e o sistema político brasileiro. Para alcançar esse objetivo, o trabalho emprega uma metodologia que combina pesquisa bibliográfica, entrevistas e análise documental. A metodologia adotada inclui uma pesquisa bibliográfica extensiva para revisar a literatura existente sobre o tema, entrevistas com uma amostra representativa de participantes, incluindo advogados, juízes, legisladores e cidadãos comuns, e análise documental de documentos oficiais e jurisprudência relevante. Os critérios de seleção de fontes e participantes foram baseados na relevância temática e na representatividade das diferentes perspectivas em relação ao tema em estudo. Os dados coletados foram analisados por meio da identificação de padrões e tendências, com o objetivo de fornecer insights sobre as dinâmicas de poder entre os poderes e as percepções em relação ao STF. Os resultados da pesquisa revelam uma variedade de perspectivas e opiniões em relação ao papel e à atuação do STF no sistema político brasileiro. Embora uma parcela significativa dos participantes reconheça o STF como uma fonte de equilíbrio institucional, há também preocupações sobre possíveis excessos e desequilíbrios na relação entre os poderes. O estudo destaca a complexidade das relações entre os poderes no Brasil e a importância de se buscar um equilíbrio saudável entre eles. Embora o ativismo judicial do STF possa desempenhar um papel crucial na proteção dos direitos fundamentais e na promoção da justiça social, é fundamental garantir que suas intervenções não comprometam o princípio da separação dos poderes e a estabilidade institucional do país. The study investigates judicial activism and the division of powers in Brazil, focusing on the interventions of the Federal Supreme Court (STF) and their implications for the country's political and legal system. Considering the context of an increasingly active Judiciary, the work seeks to understand the power dynamics between the Executive, Legislative and Judiciary branches, as well as the challenges faced in maintaining institutional balance. The objective of the study is to analyze the impact of the STF's judicial activism on the division of powers in Brazil, investigating its implications for democracy, the rule of law and the Brazilian political system. To achieve this objective, the work employs a methodology that combines bibliographic research, interviews and documentary analysis. The methodology adopted includes an extensive literature search to review existing literature on the topic, interviews with a representative sample of participants, including lawyers, judges, legislators and ordinary citizens, and documentary analysis of official documents and relevant case law. The selection criteria for sources and participants were based on thematic relevance and the representativeness of different perspectives in relation to the topic under study. The data collected was analyzed by identifying patterns and trends, with the aim of providing insights into the power dynamics between the powers and perceptions in relation to the STF. The survey results reveal a variety of perspectives and opinions regarding the role and performance of the STF in the Brazilian political system. Although a significant portion of participants recognize the STF as a source of institutional balance, there are also concerns about possible excesses and imbalances in the relationship between powers. The study highlights the complexity of relations between powers in Brazil and the importance of seeking a healthy balance between them. Although the STF's judicial activism can play a crucial role in protecting fundamental rights and promoting social justice, it is essential to ensure that its interventions do not compromise the principle of separation of powers and the country's institutional stability.
