The federal grand jury hearing evidence has returned no indictments, but the DPW Essex County official responsible for preventing survey fraud, James W. Bougioukas of Haverhill, resigned in the face of dismissal on March 16. Before forming Capital, Bahnan worked in 1985 for the private engineering firm owned by Bougioukas, who has since been identified as a main target in the probe. The work Capital performed took place in Hyde Park and several spots around Middlesex County from March to December 1986. The two men listed as its survey party chiefs had first done work for the DPW in 1957 and 1965 respectively, DPW records show. Nevertheless, state records show that [Joseph A. Arseneau] was given tentative approval on Feb. 1, 1982, shortly after he left the DPW, to work as a survey party chief in District 5. The record is unusual in that it does not list which company submitted Arseneau's name for approval.
