Summary: | Supporters of a recall election to remove Chelsea Mayor James D. Mitchell Jr. are 45 signatures short of the 2902 required by the city charter to hold that election, Judge James P. Forte ruled yesterday in Suffolk Superior Court. Of the 2973 signatures certified by the Chelsea Board of Registrars, Forte struck 171 names and added 55 leaving Timothy A. McBride and members of the recall group with 2857 valid, certified signers. Thomas P. McCusker Jr. and Simon C. Leeming, lawyers for the recall group, filed an immediate appeal to the Massachusetts Appeals Court from Forte's 22- page decision. Leeming also contended that the city charter appears to give the recall group 10 days in which to gather additional signatures, a view vigorously denied by [Albert C. Bielitz]. |
