| Abstract | In its motion, the school board and Ohio superintendent of public instruction asked Chief U.S. District Judge Walter H. Rice to lift a 1973 order that led Dayton to begin busing for desegregration. The state has promised to pay Dayton schools a $32.3 million settlement if Rice certifies Dayton has dismantled its dual system. The board and state were co-defendants in the original lawsuit that led to the court order. "To achieve the racial balancing required by the desegregation remedy, many children of all races have endured lengthy bus rides from their own neighborhoods to schools located in various areas around the city," the motion says. "During this time, the Dayton schools have undergone dramatic demographic and other changes." |
