Judicial decision between moral hermeneutics and political articulation/A decisao judicial entre a hermeneutica moral e a articulacao politica

Assuming that, in a context of judicialization of politics, judges make important political decisions, which reasons are good reasons for the intervention of judges on politics without a mischaracterization of democratic government? Some argue that the ideal would be that their decisions, even interfering in politics, have no political motivation, , for example, with a merely technical basement. But could be this technical ideal achieved? Another option, now free of the technicality taint, would be the alternative proposed by Dworkin: the judicial arguments must be arguments of principle (morally based), not arguments of policy (politically based). Is this second option more plausible? The aim of this paper is to argue that this second option, in fact, is more plausible, but, unlike desired by Dworkin, a moral hermeneutics do not escapes completely from political decisionism. Partindo do pressuposto de que, num contexto de judicializacao da politica, os juizes tomam decisoes politicas importantes, quais motivos seriam, nas maos do Judiciario, bons motivos para intervir na politica, sem descaracterizar um governo democratico? Ha quem argumente que o ideal seria que suas decisoes, por mais que interferissem na politica, nao tivessem motivacao politica, tendo motivacao meramente tecnica, por exemplo. Mas seria esse ideal tecnicista, possivel de ser concretizado? Outra opcao, ja livre da pecha tecnicista, seria a alternativa proposta por Dworkin: os argumentos do Judiciario devem ser argumentos de principio (de base moral), e nao argumentos de politica. Essa segunda opcao seria mais plausivel? O objetivo do presente trabalho e argumentar que a segunda opcao, de fato, e mais plausivel, mas que, ao contrario do almejado por Dworkin, uma hermeneutica moral nao escapa completamente do decisionismo politico.
