[논문철회] 코로나 전염병 위기와 의료자원분배의 우선순위에 대한 법적 고찰 - 독일의 논의를 중심으로

최근 코로나 19 사태를 계기로 전염병 확산과 같이 급박한 상황이 발생했을 때 의료자원의 효율적인 분배에 대하여 기준은 없다. 이러한 돌발적인 상황에 대하여 의료자원을 보다 합리적으로 배분할 수 있는 법적 기준을 마련해야 한다는 논의가 언론과 학계에서 나오고 있다. 독일과 스위스 등 유럽에서도 법조계와 의학계를 중심으로 의료자원 배분을 둘러싼 논의가 활발하게 진행되고 있다. 급박하고 제한된 상황에서 인적·물적 자원을 어떻게 나눌지 여부에 관한 기준은 분배정의의 문제와 함께 윤리적, 법적 측면에 관한 것이다. 본 연구는 코로나 19 위기상황에서 의료자원의 분배의 문제가 현장에서 의학적 기준에 의거한 의사의 판단이 반드시 법 원칙이나 기준에 합치되어야 한다는 최종적인 규범적인 판단을 하려고 하는 것은 아니다. 그러나 이러한 위기상황에서의 판단이 적어도 헌법상 원칙이나 기준에 구체적으로 합치되는 것인지에 대한 타당성의 여부를 논의하고, 이러한 논의를 토대로 사회적인 합의를 도출해 나갈 수 있는 계기를 마련하는 데 그 취지가 있다. There is no specific set of rules for dealing with the overwhelming legal demands inflicted by the COVID-19 pandemic for the legal profession and the justice system. In response to such an unexpected situation, there have been discussions in the media that a legal standard for a more rational allocation of medical resources should be prepared. Academics and scholars in Europe, including Germany and Switzerland, are actively discussing the distribution of medical resources from both a legal and a medical perspective. Setting criteria a criterion for how to allocate human and material resources in a limited situation involves distributive justice, along with ethical and legal issues. This study on the distribution of medical resources in the COVID-19 crisis is not intended to make a final normative judgment that these standards must be consistent with the court rules or standards since doctors must also judge medical standards in the field. Ultimately, the paper discusses whether constitutional principles and standards are met in such a crisis, and based on these discussions, if the pandemic presents an opportunity to draw a social consensus.
