바이오헬스 산업에서 특허 라이선스 특성에 관한 연구

바이오헬스 산업은 인간의 생명 및 국민건강과 직결되어 접근성 확보와 공평한 분배의 문제 등 공공성이 중요한 특성을 갖는다. 이에 최근 코로나19 백신 등 관련 지재권 보호의무 면제 이슈를 비롯하여, 강제실시권 제도의 활성화, 바이오 기술의 무상 공유 등의 문제가 꾸준히 제기되어 왔다. 그러나 장기간의 대량 투자가 필요한 바이오헬스 산업에서 기술공유와 지재권에 대한 독점권 약화는 기업의 입장에서 기술혁신에 대한 인센티브를 저해한다는 부정적 의견도 다수 존재한다. 이에 바이오헬스 분야에서 특허 라이선스 특성을 분석하여 공정하고 개방적인 라이선스를 도모하면서도 기술혁신에 대한 동기부여의 역할을 유지할 수 있는 방안에 대한 고민이 필요하다. 이 글에서는 바이오헬스 분야에서 실질적으로 이루어지고 있는 특허 라이선스 모델 및 사례를 분석하여 현행 제도의 문제점 및 미흡한 점을 도출하고, 효율적인 기술이전과 개방형 혁신이 이루어질 수 있는 방안을 모색해 보았다. 이를 위하여 먼저 바이오헬스 산업의 범위를 특정하고, 바이오헬스 산업과 해당 산업에서 특허 라이선스의 특수성을 분석한다. 다음으로 바이오헬스 분야에서 주요 라이선스 모델 및 사례의 조사･분석을 통하여 개선이 필요한 부분을 도출하였다. 이를 통해 바이오헬스 산업에서 효율적 기술이전 및 기술확보와 더불어 기술혁신 촉진을 위한 제도적･정책적 대응 방안을 제시하였다. The biohealth industry is directly related to human life and national health, and has important characteristics of publicity such as securing accessibility and fair distribution. Accordingly, issues such as exemption from the obligation to protect intellectual property rights, such as the COVID-19 vaccine, activation of the compulsory license system, and free sharing of biotechnology have been steadily raised. However, there are many negative opinions that technology sharing and the weakening of monopoly rights over intellectual property rights in the biohealth industry, which requires long-term mass investment, hinders incentives for technological innovation from the point of view of companies. Therefore, it is necessary to think about ways to maintain the role of motivating technological innovation while promoting fair and open licensing by analyzing the characteristics of patent licenses in the biohealth field. In this article, we analyzed patent licensing models and cases that are actually being carried out in the field of biohealth to derive problems and shortcomings of the current system, and searched for ways to achieve efficient technology transfer and open innovation. For this purpose, the scope of the biohealth industry is first specified, and the specificity of the biohealth industry and patent licenses in that industry is analyzed. Next, areas requiring improvement were derived through investigation and analysis of representative license models and cases in the biohealth field. Through this process, institutional and policy countermeasures were proposed to promote technological innovation along with efficient technology transfer and technology securing in the biohealth industry.
