LA TUTELA PRECONTRACTUAL EN LA LEY 19.496 SU CONFIGURACIÓN, ALCANCE Y EVENTUAL CONVERGENCIA CON AQUELLA PROPIA DE LA CONTRATACIÓN CIVIL

El presente trabajo aborda la configuración de la tutela precontractual en la Ley 19.496 con el propósito de establecer los supuestos de hecho que la activan e identificar los medios de tutela de que dispone el consumidor, así como las particularidades de estos últimos respecto de los previstos para supuestos similares en la contratación civil, explorando la eventual convergencia de tutelas y delimitando el ámbito de aplicación de dicha Ley en la fase de formación del contrato. The present work aims to tackle the configuration of the pre-contractual protection in law 19.496 with the purpose of establishing the hypotheses that activate it and to identify the remedies of the consumer and its particularities with respect to those foreseen for similar cases in civil contracting, exploring the eventual convergence of both and delimiting its scope of application in the phase of formation of the contract.
