In Taiwan, courts and scholars have controversies over the level of the creativity required in determining the originality of photographic works. Therefore, there are inconsistent court decisions regarding the originality of photographic works, especially photographic renditions. This article analyzes the current originality standards of photographic works applied by Taiwan courts and relevant decisions reached by US courts and suggests different standards of originality for different types of photographic works.
我國現行司法實務及學說，對於攝影著作所應具備之創意高度向有爭議。以致實務審判中，對於攝影著作原創性之判斷，容易產生不同認定。特別是對於以精確重現原物為目的之攝影著作是否具原創性，見解紛歧。 本文擬分析我國現行攝影著作原創性之認定標準，並參酌英美法院相關判決，彙整出不同類別攝影著作採行之原創性判定標準及著作權保護範圍，作為我國未來司法實務及智慧財產權權利管理之參考
