by A bench of Chief Justice D Y Chandrachud, Justices J B Pardiwala, Manoj Mishra had said Climate change may impact the constitutional guarantee of the right to equality Without a clean environment which is stable, unimpacted by the vagaries of climate change the right to life is not fully realised The right to health which is a part of the right to life under Article 21 is impacted due to factors such as air pollution shifts in vectorborne diseases rising temperatures droughts shortages in food supplies due to crop failure storms, floodingIn the Telangana matter writing the 60page judgment Justice Sundresh said These two provisions qua a forest ought to be understood in light of Articles 14 19, 21 of the Constitution We say so as they represent the collective conscience of the Constitution If the continued existence, protection of forests is in the interest of humanity various species, jaundiced eyes of humans but through the prism of the environment the forest in particularHe further said Forests play a pivotal role in controlling pollution which significantly affects underprivileged violating their right to equality under Article 14 It is the vulnerable sections of society who would be most affected by the depletion of forests because more affluent sections of society have better access to resources as compared to them Therefore protection of forests is in the interest of mankindSC said the anthropocentric approach must give way to ecocentric approach Wealth of a country must be seen not only from the perspective of mere revenue augmented through its industries, business activities Rather it must be seen by giving due importance to its natural wealth which contributes much more than the other factors it said
