The bench of Justices A Muhamed Mustaque, P Krishnakumar on Saturday condoned the delay in filing the appeal as the single benchs order was issued on May 25 2023 The bench scheduled the appeal for further hearing on Nov 11 Un der Section 21g of the ART Regulation Act 2021 the upper age limit for women seeking ART services is 50, high courtPreviously while considering these petitions the single bench observed that an individuals personal choice to procreate, build a family is a facet of their fundamental rights The bench noted that setting an upper age limit restricts this right, directed the national assisted reproductive technology, surrogacy board to inform the central govt about the need to reevaluate the age limit prescribed in Section 21g of the Act within three monthsIn its appeal however the Union govt argued that the age restriction was imposed with the welfare of the child in mind asserting that the right of the unborn child cannot be overlooked in fulfilling a couples desire to become parents
